There is an evidence that the founder of Theranos, Elizabeth Holmes, is a flight risk.
The 38-year-old booked a one-way ticket to Mexico in an attempt to "flee the country" after being convicted by a jury on four counts of fraud and conspiracy in January, 2022, prosecutors said in a motion filed Thursday in federal court in Northern California.
Holmes was sentenced to 11 years in prison on November 17, by a U.S. District Judge Edward Davila. Holmes who was pregnant that time was ordered to report to prison on April 27, giving her enough time to give birth to her second child before she is incarcerated. She gave birth to a son shortly before her trial started last year.
Then, prosecutors did not refuse Davila’s decision to give Holmes five months of freedom. Now, they are arguing that she should begin her sentence, citing her suspect travel plans and her current living arrangements on an estate with reported monthly expenses of $13,000 as evidence she is a flight risk.
Holmes booked the 2022 flight without a scheduled return trip and only canceled it after prosecutors contacted her attorneys about the “unauthorized flight,” prosecutors said.
She is scheduled to return to court on March 17 for a hearing on her request to stay out of prison while appealing her conviction.
